Warranty
Nokia warrants the memory card to be free from defects in materials and
workmanship under normal use for a period of twelve (12) months from the
date of delivery to you as evidenced by a copy of your receipt. This warranty is
limited to the original purchaser and is not transferable.
ANY SOFTWARE APPLICATIONS INCORPORATED IN THE MEMORY CARD ARE
PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED,
AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW NEITHER
NOKIA, ITS LICENSORS OR AFFILIATES NOR THE COPYRIGHT HOLDERS MAKE
ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING
BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY OR FITNESS
FOR A PARTICULAR PURPOSE OR THAT THE SOFTWARE APPLICATIONS WILL
NOT INFRINGE ANY THIRD PARTY PATENTS, COPYRIGHTS, TRADEMARKS OR
OTHER RIGHTS. THERE IS NO WARRANTY BY NOKIA OR BY ANY OTHER PARTY
THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE APPLICATION WILL
MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE
APPLICATION WILL BE UNINTERRUPTED OR ERROR-FREE.
This limited warranty is void if failure of the card has resulted from accident,
abuse or misapplication.
During the twelve (12) months’ warranty period Nokia will replace the
memory card not meeting the foregoing warranty and which is returned to
Nokia or an authorised Nokia reseller with a copy of your receipt. If Nokia or
Nokia’s authorised reseller is unable to deliver a replacement card, which is
free from defects in material and workmanship, you may terminate this
agreement by returning the memory card and your money will be refunded.
NOKIA DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED,
INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE MEMORY
CARD. NOKIA SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER
(INCLUDING, WITHOUT LIMITATION COSTS OF PROCUREMENT OF SUBSTITUTE
GOODS, PROPERTY DAMAGE, PERSONAL INJURY, LOSS OF PROFITS,
INTERRUPTION OF BUSINESS, OR FOR ANY OTHER SPECIAL, CONSEQUENTIAL
OR INCIDENTAL DAMAGES) ARISING OUT OF THE USE OF OR INABILITY TO USE
MEMORY CARD, EVEN IF NOKIA OR ITS SUPPLIERS OR THE OTHER PARTY OR
PERSON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY
CASE, NOKIA’S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS WARRANTY
OR THIS USERS’ GUIDE SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID
BY YOU FOR THE MEMORY CARD.
