PECUNIARY LOSS) ARISING
OUT OF THE USE OF OR
INABILITY TO USE THE
SOFTWARE OR ANY THIRD
PARTY SOFTWARE, EVEN IF
RIM HAS BEEN ADVISED OF
THE POSSIBILITY OF SUCH
DAMAGES. THIS LIMITATION
IS INTENDED TO APPLY AND
DOES APPLY WITHOUT
REGARD TO WHETHER SUCH
DAMAGES ARE CLAIMED,
ASSERTED OR BROUGHT IN
AN ACTION OR CLAIM
SOUNDING IN TORT OR
CONTRACT, OR ON THE
WARRANTY, OR UNDER ANY
OTHER LAW OR FORM OF
ACTION. IN NO EVENT
SHALL RIM’S LIABILITY TO
YOU EXCEED THE COST OF
REPLACING THE MEDIA
UPON WHICH THE
SOFTWARE IS RECORDED.
4.6 This SOFTWARE is provided
with RESTRICTED RIGHTS.
Use, duplication or disclosure
by the U.S. Government is
subject to restrictions as set forth
in DFARS 227.7202 or in FAR
52.227-19, as applicable.

4.7 This LICENSE is to be
construed in Canada under the
laws of the Province of Ontario
and in the United States under
the laws of the State of Texas,
except for any body of law
